We successfully argued in the Supreme Court that a man charged with murder should be granted bail.
Our client was charged with driving whilst disqualified by a court order. He was on a suspended sentence for the same offence. He had recently started a new business and needed to drive to conduct the business. Mark Howden successfully argued that a lengthy period of disqualification would be a significant punishment. In addition a term of actual imprisonment would cause the business to fail. Our client was placed on a period of probation and the operational period of his suspended sentence was increased. We referred to the case of Santillan V Queensland Police Service [2008] QDC 33.
