Client Receives A Directed “Not Guilty” Verdict On Police Bashing Trial

Monday, June 15th, 2009

Our client was charged with the grievous bodily harm of two off duty police inspectors at Yeronga Park.

It was alleged that he and three other men attacked the officers after a police Christmas function at the rugby club.   Although identification of our client was questionable the trial proceeded. Following skilful cross-examination by counsel John Allen instructed by solicitor Kate Juhasz as to the photoboard process and whether our client could be distinguished from others that night, the Judge directed the Jury must return a not guilty verdict and our client was acquitted at the end of the Crown case.

No Conviction For 57 Ecstasy Tablets – May 2009

Thursday, June 4th, 2009

Our client, who is in Australia on a working visa, was arrested in Fortitude Valley with 57 ecstasy tablets. He was also originally charged with supplying the tablets to other people. Peter Saggers successfully argued that he was only in possession of the tablets and did not supply them to anybody.   Reference was made to a Court of Appeal decision in Holmes [2008] QCA 259. The recording of a conviction would have had a detrimental effect on his application for permanent residence. The Supreme Court agreed and ordered that he be placed on a probation order and did not record a conviction.
